As artificial intelligence transforms how evidence is created and presented, courts and legal professionals must adapt. This guidance features a webinar and two bench cards to help judges evaluate AI-generated content and ensure fair, informed decisions that preserve the integrity of judicial proceedings.

AI-generated evidence is becoming more common and more complex.
While fabricated evidence is not a new problem in state courts, the rise in accessibility of artificial intelligence (“AI”) has made it easier to enhance, alter, or to create fake digital evidence that looks convincingly real.
Meanwhile, the increased sophistication of AI technology has made detecting such manipulation more difficult than ever. Issues related to evidence that is actually or allegedly generated or altered by AI may take two forms: one where the use of AI is acknowledged in the generation, alteration, or production of evidence, such as enhancement of a photo or audio (“acknowledged AI- generated evidence”), and a second, where evidence is offered by one party and another party challenges its authenticity.
